Welcome! Chani Nicholas Incorporated  (“us”, “we”, or “our”) operates https://www.chaninicholas.com and related subdomains  (hereinafter referred to as the “Site”).

Our Privacy Policy governs your visit to the Site, and explains how we collect, safeguard and disclose information that results from your use of our Site.

We use your data to provide and improve the Site. By using the Site, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Our Terms and Conditions (“Terms”) govern all use of our Site and together with this Privacy Policy constitutes your agreement with us (“Agreement”).

 

WHAT PERSONAL DATA WE COLLECT, AND WHY WE COLLECT IT

DEFINITIONS:

BIRTH CHART INFO means your birth date, time, and location.

BIRTH CHART TOOL means the web application available at chart.chaninicholas.com.

PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

USAGE DATA is data collected automatically either generated by the use of Site or from Site infrastructure itself (for example, the duration of a page visit).

COOKIES are small files stored on your device (computer or mobile device).

DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your data.

DATA PROCESSORS (OR SERVICE PROVIDERS) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Site Providers in order to process your data more effectively.

DATA SUBJECT is any living individual who is the subject of Personal Data.

The USER is the individual using our Site. The User corresponds to the Data Subject, who is the subject of Personal Data.

INFO WE COLLECT:

The Personal Data we collect through various parts of the Site includes:

BIRTH CHART TOOL:

Your Personal Data is collected through the Site for two primary purposes: to deliver content to you upon your request via email, and to produce and display your chart at chart.chanicholas.com. We use the emails supplied through chart.chaninicholas.com to deliver our ongoing communications, including without limitation to send newsletters and announce and advertise workshops.

We will never sell your Personal Data to third parties, and share it only as set forth in this Policy.

We provide further details about how we use this data below.

EMBEDDED CONTENT:

Articles on this Site may include embedded content (e.g. videos, images, articles, etc.). Embedded content is served from other websites (for example, Youtube or Spotify) and is subject to the terms and privacy policy applicable to the source of the embedded content, whether displayed on the Site as an iFrame, link, or otherwise. We are not responsible for the collection and use of your Personal Data on or by third parties, some of whom may use tracking technology that works across many other websites. If you have any doubts as to whether you consent to the data handling practices of such other sites, please do not click, interact with, or otherwise access embedded content.

GOOGLE ANALYTICS TRACKING:

Our website uses Google Analytics tracking to measure traffic data. We use the WordPress plugin “Google Analytics Dashboard for WP (GADWP)” to place the tracking code. This plugin is set to anonymize use IP data and respect “Do Not Track” browser features so that no personal data is stored.

NEWSLETTER:

You will be added to our email list with your explicit consent (for example, via checkbox on signup form, or double email opt-in) or automatically when you access our Birth Chart Tool.

Our newsletters and other announcements are sent through a third party email service, which may use web beacons to track your interactions with our email – for example, whether an email is opened or clicked. We have access to this tracking information.

 

OUR COLLECTION AND USE OF PERSONAL INFORMATION DURING SHOPIFY PURCHASES

This section describes how your personal information is collected, used and shared when you visit or make a purchase from http://chani-nicholas.shopify.com (the “Shopify Site,” owned and operated by Shopify).

 

PERSONAL INFORMATION COLLECTED BY SHOPIFY:

When you visit the Shopify Site, Shopify automatically collects certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Shopify Site, Shopify collects information about the individual web pages or products that you view, what websites or search terms referred you to the Shopify Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Shopify Device Information.”  Shopify Device Information is shared back with us.

HOW SHOPIFY USES YOUR PERSONAL INFORMATION:

We use the Shopify Order Information that we collect generally to fulfill any orders placed through the Shopify Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: communicate with you; screen our orders for potential risk or fraud; and for advertising relating to our products.

We use the Shopify Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

BEHAVIORAL ADVERTISING:

As described above, we may use your Personal Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example, we may show users who have purchased one of our courses or signed up for our newsletter specific advertisements.

DO NOT TRACK:

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser other than in connection with the Google Analytics service.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site and/or Shopify Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States, and will be stored on servers located in the United States.

HOW WE STORE YOUR DATA:

We retain records of your purchases with us indefinitely in order to generate ongoing business intelligence. 

When you utilize the Birth Chart Tool, your Birth Chart Info is sent to a 3rd party API to receive a customized response, but not stored in any database or server. Your name and email are stored in/on our Mailchimp list (alongside any unsubscribe request to keep you opted-out if you choose to opt-out) and a database that we control and secure.

Usage information about the Site is stored on third party servers through the service Media Temple. You can view the privacy policies applicable to Media Temple for US-based users at:

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

 

WITH WHOM WE SHARE YOUR DATA:

We do not share your Personal Data except as explicitly described in this Privacy Policy.

Cookies and visitor data are among our routine site backup systems and are operated by third parties including The Wonder Jam and ManageWP.

Contracted, third-party developers and API tools have access to Personal Information in the course of and for the sole purposes of creating, delivering, and maintaining our Birth Chart Tool. We send only the information to our API Tools necessary to obtain information about the positions of celestial objects relevant to your birth chart at the time of your birth. Both our API partners and our third party developers are subject to strict confidentiality and use restrictions which limit their handling of the Personal Data obtained during the course of providing services to us to usages in the course of operating the Birth Chart Tool.

Specifically, your Personal Data is shared as follows in connection with our Birth Chart Tool:

• To a third-party API to obtain the contents of your chart (Birth Chart Info);
• To our third-party servers in order to process the display of your chart, allow you to email yourself a copy of your chart, and maintain confidential records of your contact Information for future communications and account management (Birthday, Birthplace, Name, and Email associated with this info);
• To our third-party Mailing service to transmit our communications to you (Name, Email);
• With our dedicated development team to manage our servers, which is subject to stringent confidentiality and use restrictions in assisting us with handling your information (Birthday, Birthplace, Name, Email associated with this info);

Your Personal Data is shared as follows in connection with the remainder of our Site:

We may share, or allow access to, your Personal Data by Shopify (our online store / shopping cart software) to analyze purchase behavior and fulfill orders, Stripe (our PCI-DSS compliant payment processor) to process payments, and UPS/FedEx/USPS (shipping) to fulfill orders placed through our Site. We may disclose Personal Data that we collect, or you provide:

(a)  Disclosure for Law Enforcement. Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities. We will not share your Personal Information with law enforcement absent a warrant or comparable court order specifically requesting an individual’s personal information.

(b)  Business Transactions. If we or our subsidiaries are involved in an asset sale, your Personal Data may be transferred.

YOUR RIGHTS WITH RESPECT TO STORED PERSONAL DATA:

If you have submitted Personal Data to us, you can request to receive an exported file of the Personal Data we hold about you, including any data you have provided to us. You can also request that we erase any Personal Data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Please note that we are unable to remove your Personal Data from the systems or servers of third parties such as Stripe.  Please contact such third parties directly to request the modification or removal of your information from their systems.

HOW WE PROTECT YOUR DATA:

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We also use regular malware scanning.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

Shopify implements a variety of security measures when a user who places an order enters, submits, or accesses their information, to maintain the safety of your personal information on the Shopify Site. All transactions are processed through a gateway provider and are not stored or processed on our servers.

The security of your data is important to us. Nonetheless, please be advised that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
